Import of Cylinders and Valves

No person shall import any cylinder filled or intended to be filled with any compressed gas except under and in accordance with the conditions of a licence granted under these rules and the relevant provisions of Foreign Trade (Development and Regulation) Act, 1992 – Rule 29.

The cylinders/valve shall be of a type and standard as specified in Schedule I of the Gas Cylinders Rules, 2004 and approved by the Chief Controller of Explosives. 

The following documents are required to be submitted by the applicant:-

  • An application in form ‘B’ duly filled in and signed.
  • Manufacturers test & inspection certificate complete in all respects pertaining to    each lot of cylinder and valve.
  • In case cylinders are desired to be imported duly filled with gas, filler’s certificate in respect of item 3(vi)(vii)(ix) of the form ‘B’ shall be furnished.
  • Demand draft drawn for the amount as shown in Schedule V drawn on any Nationalised Bank in favour of Chief Controller of Explosives payable at Nagpur
  • Copy of DGFT licence
  • Details of the storage licence in Form ‘F’ of the Gas Cylinders Rules, 2004
  • The details of the end user and their storage licence particular under the Gas Cylinders Rules, 2004
  • The available infrastructure for safe handling and storage with the importer and user
  • Details of emergency handling facility and equipment available in case of leakage
  • Details of technical experienced and trained manpower available for handling and storage of cylinders as per the provisions of the Gas Cylinders Rules, 2004.
  • NOC/permission from Ministry of Environment and Forests under Ozone Depleting Substances (Regulation & Control) Rules, 2000 in case of ODS.
  • Permission from Department of Atomic Energy in case of radio active material.
  • Six-monthly returns giving status of the consignments already imported by you under the strength of earlier import licences obtained for the various consignments of the gas cylinders as per the format enclosed.
  • Documentary evidence in respect of the facilities where the disposal and condemnation of the cylinders proposed to be to be carried out after use.
  • An undertaking stating that the shipment shall be cleared from the port expeditiously upon arrival at the ports and the intimation in respect of the same shall be furnished to this office immediately.  The copies of the re-export bond where applicable, shall also be furnished along with such intimation.

Additional Conditions:-

  • The shipment shall be cleared from the port expeditiously upon arrival at the ports and the intimation in respect of the same shall be furnished to this office as well as the Customs authority immediately but not later than 21 days.  The copies of the re-export bond where applicable, shall also be furnished along with such intimation.
  • All other applicable laws like Environment (Protection Act), 1986, Central Motor Vehicle Act /Rules shall be complied with.
  • In the case of imports of gases in supplier’s returnable cylinders, copy of re-export bond and bank guarantee executed to President of India through Commissioner of Customs shall also be submitted.
  • The foreign cylinder/valve manufacturers who desire to take approval under Gas Cylinders Rules, 2004 may follow the procedure laid down under Rule 3 of the aforesaid Rules. They may also approach Bureau of Indian Standards for registration of the product as per the equivalent Indian Standards under Certification Scheme for Foreign Manufacturers.
